INFORMATION ABOUT THE GENERAL CONDITIONS
OF THE CHARTERED COMPANY

ARTICLE 1: EXECUTION OF CONTRACT

The different provisions of the said contract – in particular the reservation of an aircraft do not come into effect until it is duly signed and returned by an authorised representative of the client’s enterprise. By fax or by mail to SVS Agency at 71 route de la Reine, 92100 Boulogne or HeliParis, its partner and commercial representative, whose headquarters are situated at 102 Avenue des Champs Elysées, 75008 Paris.

ARTICLE 2: HOURS – DEVIATION

The hours planned and accepted by the client are only given as an indication. The airline company reserves the right to modify or even cancel all or part of a flight for security reasons, aviation security, meteorological conditions, technical or authorisation demands. In the case of a deviation, the airline company shall pay the expenses incurred concerning the aircraft, the client is liable for those related to the repatriation of passengers or freight. In any case the client will be liable for the cost of the chartering.

ARTICLE 3: MODIFICATIONS

The said contract cannot be prolonged nor modified without the client having obtained the prerequisite agreement of the company concerned or its commercial representative (HeliParis), who, if need be, will give all the necessary instructions to the crew. Except in urgent or exceptional cases, the crew does not receive instructions from the client. Any changes to the said contract will result in a supplement to the bill, credit note or a debit on the basis of the current tariff. In the case of sub-contracting, that transport company shall be responsible for the correct execution of the mission.

ARTICLE 4: SERVICE ON BOARD

Extra services may be given on board, when asked for at the time of establishing the estimate (coffee, tea, pastries, daily press, open-bar, champagne and or tray-meals) in this case some of the services will charged as supplements.

ARTICLE 5: INSURANCE

The airline company insures its planes in accordance with the general conditions of the Warsaw Convention. The client is free to take out another private insurance. The passengers will be covered by the said transport company. The Warsaw Convention appoints the Convention for the unification of certain state controls related to international airline transport, signed in Warsaw on 12th October 1929 or of the same Convention, amended in the Hague on 29th September 1955, according to whichever one is applicable. The Warsaw Convention may be applicable if the final destination or a stopover of the passenger is in another country than that of the departure. The Convention of Warsaw manages and in most cases limits the responsibility of the airline company in the case of death or corporal damage as well as loss or damaged luggage. The transport taken corresponding to the said ticket, is under the rules and limitations of responsibilities decreed by the Warsaw Convention, except in the case where the transport is not “international transport” in the sense of the said Convention.

HeliParis also has an RC Charter Insurance with Axa Corporate.

ARTICLE 6: INTERNATIONAL FLIGHTS

In the case of a flight having one or several stopovers outside of France, the client is responsible for seeing his/her official papers, that may be required, are in order, such as passports, visas etc...

ARTICLE 7: PAYMENT METHODS

A deposit of 50% of the total price is due on signing the contract. The rest is payable 7 working days before the flight. Before the embarkation, at the latest.

ARTICLE 8: PENALTIES FOR ANNULATION

Refer to estimate established by HeliParis and invoiced by its partner S.V.S. Agency - 71 Route de la Reine - 92100 Boulogne.

ARTICLE 9: FUEL COST

The company reserves the right to modify the cost of the charter, taking account of a possible increase in the cost of fuel, additional costs of landing taxes, and complementary insurance for countries at risk.

ARTICLE 10: DELAYED EMBARKATIONS

The passenger shall be present for the embarkation:

- HELICOPTER: 15 minutes before the depart
- PRIVATE JET: 30 minutes before the depart
- CHARTER (without luggage): 1h15 before the depart
- CHARTER (with luggage): 1h45 before the depart

For charter flights the client will be responsible for any delay caused by passengers and liable to an increase in tariff for every hour of delay.

ARTICLE 11: LUGGAGE

Maximum weight per person: 15 kg (standard dimensions) or depending on the number of passengers boarding. The company will not be held responsible in any case for forgotten objects, loss or damage caused by negligence on the part of the client.

ARTICLE 12: FREIGHT

For all freight transport the client handles customs declarations, and others related to the merchandise transported.

ARTICLE 13: LITIGATION

Complaints made four days after the flight will not be taken into consideration. All disputes over the interpretation or the execution of the said contract of rental, will come under the exclusive competence of jurisdiction of the headquarters of the company.
